Terms of Service

1. Introduction
CompactHive is a managed infrastructure platform operated by David Utěšil, IČO: 87793016, Prague, Czech Republic ("we", "us", "the operator").
By creating an account or using CompactHive, you agree to these Terms of Service. If you do not agree, do not use the service.
2. Eligibility
CompactHive is intended for business and professional use. By creating an account, you represent that you are acting in a professional or business capacity, not as a consumer. You must be at least 18 years old, and the information you provide must be accurate and complete.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
Each account corresponds to one tenant organization. You may invite team members to your organization through the portal.
4. Service Description
CompactHive provides managed Kubernetes infrastructure with integrated services including source control, CI/CD, databases, monitoring, and other development tools. The specific services available depend on your subscription tier.
We reserve the right to modify, add, or remove services from the platform with reasonable notice. Material changes that reduce functionality on your current tier will be communicated at least 30 days in advance.
5. Free Trial
The Basic tier includes a 14-day free trial. No payment method is required to start the trial.
After the trial expires:
- You have a 7-day grace period to add a payment method. Your environment continues to run during this period.
- If no payment method is added after the grace period, your environment will be paused (workloads stopped, data preserved).
- You have 30 days to reactivate by adding a payment method. Your environment will be restored automatically.
- After 30 days in paused state without payment, your environment and all data will be permanently deleted.
6. Billing and Payment
Paid subscriptions are billed monthly in EUR at the prices listed on the pricing page. Payment is processed securely through Stripe. We do not store your full card details.
You may cancel your subscription at any time. Upon cancellation, you retain access to your environment until the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
We reserve the right to change pricing with at least 30 days written notice. Price changes apply from the next billing cycle after the notice period.
7. Acceptable Use
You agree not to use CompactHive to:
- Host, distribute, or facilitate illegal content or activities
- Distribute malware, phishing pages, or tools designed for unauthorized access
- Send unsolicited bulk email (spam)
- Mine cryptocurrency or run other resource-intensive workloads designed to exploit shared infrastructure
- Intentionally disrupt or degrade the service for other users
- Attempt to access other tenants' data or infrastructure
- Perform unauthorized network scanning or penetration testing against our infrastructure or other tenants
- Circumvent resource quotas or security controls
- Host content that infringes intellectual property rights after receiving notice
- Violate applicable export control or sanctions regulations
We may suspend or terminate accounts that violate this policy, with or without prior notice depending on the severity of the violation.
8. Your Data
You retain full ownership of all data you store on CompactHive, including application code, databases, files, and configurations.
We do not access, inspect, or analyze your workloads or data except when necessary for operational purposes (e.g., troubleshooting infrastructure issues, responding to security incidents, or complying with legal obligations).
We do not sell, share, or monetize your data in any way. See our Privacy Policy for full details on data handling.
9. Service Availability
We commit to best-effort availability for shared infrastructure and 99.5% uptime for the Private Infrastructure add-on. Full details, including downtime definitions, service credits, and exclusions, are in our Service Level Agreement.
Scheduled maintenance will be communicated at least 48 hours in advance via email. We will make reasonable efforts to perform maintenance during low-traffic hours (00:00–06:00 CET).
We are not liable for downtime caused by factors outside our control, including but not limited to: upstream provider outages, network failures, natural disasters, or force majeure events. See the SLA for the full list of exclusions.
10. Limitation of Liability
The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, our total liability for any claims arising from your use of the service is limited to the fees you paid in the three (3) months preceding the claim.
We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of revenue, or business interruption.
You are responsible for maintaining your own backups. While we provide backup tools (e.g., Velero), we do not guarantee data recovery in all circumstances.
11. Termination
By you: You may cancel your subscription and delete your account at any time through the portal or by contacting support. Access continues until the end of the current billing period. All customer data is deleted from live systems within 30 days of account closure. Data may persist in encrypted backups for up to 30 additional days, after which backups are automatically rotated. Accounting records (invoices, transaction history) are retained as required by Czech law.
By us: We may suspend or terminate your account if you violate these terms, fail to pay, or if we discontinue the service. In the case of service discontinuation, we will provide at least 90 days notice and assist with data export.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.
13. Governing Law
These terms are governed by the laws of the Czech Republic. Any disputes arising from these terms or your use of the service shall be resolved in the courts of the Czech Republic.
